Terms and conditions
Section 1
Client and therapist
No treatment of any kind will be given to any persons under the age of 18 (eighteen) years of age.
Better Life Therapy accepts no legal, financial, or material responsibility for any loss of income or loss of property ether during or after any treatment, session, or consultation given by Better Life Therapies or any persons involved therein.
Better Life Therapies accepts no responsibility for any legal or financial problem or concern incurred by the client ether during or after any treatment undertaken from Better Life Therapies or any persons involved therein.
Better Life Therapies accepts no responsibility, legal or otherwise for any injury, medical condition, medical concern, or any other medical or health related issue pertaining to the client both before and after the clients treatment(s) and or session(s).
Better Life Therapies accepts no responsibility, legal or otherwise for any loss of income because of injury, or other physical, mental or emotional concern to do with the client
It is the clients responsibility to inform the therapist of any and all issues, medical or otherwise that are of concern that may, or have lead to medical problems in the past.
It is the clients responsibility to answer all questions asked by the therapist honestly and in full.
The client, by signing and consenting to be treated, does absolve Better Life Therapies and any persons associated therewith of ANY AND ALL responsibility for any of the things or situations contained within, but not limited to the things and situations contained within this document, the client does agree to, treat the therapist and all other persons connected with Better Life Therapies with respect.
The therapist agrees to treat the client with respect and to respect boundaries and modesty in all occasions.
Client safety
Upon initial consultation, and in every dealing with Better Life Therapies thereafter, the client is given a unique reference number, this number is only to assist with communication Between Better Life Therapies, the client and the clients Doctor.
Should any communication be required between Better Life Therapies and the clients Doctor, written, signed and Dated permission will be required from the client, However, if, in the belief of Better Life Therapies, the client is in danger, ether from themselves, or from an external source, Better Life Therapies reserves the right to notify any and all relevant persons in the interest of the clients safety.
Communication with clients Doctor
Better Life Therapies, reserves the right to communicate with the clients assigned Doctor, but will ONLY DO SO with written, signed and Dated permission from the client, communication with a clients doctor will ONLY be done for clarification reasons, However, if, in the belief of Better Life Therapies, the client is in danger, ether from themselves, or from an external source, Better Life Therapies reserves the right to notify any and all relevant persons in the interest of the clients safety.
1a. Respect
Non confrontational language is required in order for treatments given by the Therapist to be effective, being respected is a right of everyone and it is this that the Therapist expects, and in return, the same respect will be given by the therapist to the client.
The therapist reserves the right to cease any and all treatment if…
There is a hostile and or dis respectful environment in which the therapist is expected to work
Hostility is given ether physically or verbally towards the therapist
An emergency situation arises for the therapist
The police or any other emergency service require the therapists help or assistance
Payment has not been received for ether current services or past services
Incorrect payment(s) are given for ether past or current treatments
Any sign of inappropriate attraction or actions are displayed on the part of the client or any of the clients family
The therapist agrees to act in an appropriate manner at all times.
The client may be excused from payment if…
The therapist acts in an inappropriate manner and such behaviour can be proven
An emergency arises for the client and the re arrangement of appointment(s) is not possible
A sudden financial crisis has arisen (please note, payment plans are available and in the case of a sudden financial crisis, the client is expected to firstly try payment through an agreed plan, further discussion is possible if circumstances do not change for the client, proof of financial crisis is required in such circumstances)
The police or other emergency service require the clients assistance or help and re arrangement of appointments is not possible
1b. cancellation and alteration of appointments
The client may alter or change a pre booked appointment by giving the therapist 24 (twenty four) hours notice, if correct notice is not given, the appointment can still be cancelled but full payment of the agreed amount for that session and any others effected will be required.
The therapist may also cancel or re arrange appointments, and must also give 24 (twenty four) hours notice where possible.
Exceptions, where appropriate notice can be disregarded on the part of client or therapist include
Medical emergency on the part of the client or clients family member, or on the part of the therapist or therapists family
Legal reasons, to include but not limited to court appearances, jury duty, arrest etc
Unforeseen circumstances, to include but not limited to traffic problems, car problems, accidents, family or personal emergencies such as medical or personal
Scheduled conflicts (in these cases, the client or therapist is firstly expected to try and re arrange any appointments firstly)
1c. Behaviour
The client and Therapist are expected to maintain appropriate behaviour at all times, the therapist will maintain appropriate distance from boundaries put in place by the client before treatment sessions begin.
The client and therapist are expected to have a non confrontational relationship, the therapist reserves the right to stop any and all treatments if ether verbal or physical violence is instituted towards them, a non tolerance policy is in effect.
No sexual advancements on the part of the client towards the therapist will be tolerated, and treatment will be immediate stopped in such circumstances, immediate payment for all booked sessions will be due and no further bookings from the involved individual will be taken.
Confrontation is understood to mean
Physical assault in its legal definition
Verbal assault in its legal definition
Mental assault in its legal definition
Emotional assault in its legal definition
Sexual advancements are understood to mean
Arousal during any and all treatments
Inappropriate sexually orientated comments
Inappropriate sexually orientated behaviour
Section 2
Data protection
All clients data which is given in written or verbal form will be treated as confidential under current data protection laws, no information will be sold, or traded.
All client data obtained from treatments will be treated as confidential and kept securely. However, if, in the belief of Better Life Therapies, the client is in danger, ether from themselves, or from an external source, Better Life Therapies reserves the right to notify any and all relevant persons in the interest of the clients safety.
Better Life Therapies may, on occasion use a clients data for email marketing and survey reasons.
All data will be held securely and treated as confidential.
We have an obligation under the law to assist all law enforcement agencies, in such cases, appropriate documentation must be obtained by police in order to secure the use of client data.
2a. The use of video and recording sessions
Better life Therapies uses video recording devices to make records of clients sessions, these recordings are kept by us and stored under data protection rules, videos of sessions are used only by Better life Therapies, and only as a record of sessions.
Videos kept of client sessions may also be used by Better Life Therapies for legal reasons if needed.
2b. email marketing
Better Life Therapies may, on occasion use data obtained from clients for marketing reasons, this can include, but is not limited to, marketing new offers, offering new products or services, all client data is protected by data protection laws
Section 3
Payments and payment plans
Clients are responsible for prompt payment of the agreed amount given in writing at the commencement of the treatment proses.
Failure to make payment(s) on the agreed date(s) for the amount(s) agreed without prior notification of any emergencies outlined bellow will result in a contract breach, and full payment of the agreed money(s) will be immediate due and legal proceedings may be taken to retrieve the amount owed by the client.
The client may, if needed, request an extension of 5 (five) days to allow payment, however this extension is used at the sole discretion of Better Life Therapy and may be refused, if refused, payment of the pre agreed amount will be due in full and legal proceedings may be taken to recover the amount owed by the client.
An alternative no contact period of 30 (thirty) days may be requested for reasons listed bellow.
All extensions and no contact periods are under the sole discretion of Better Life Therapies and may be cancelled, discontinued or refused at any time.
If payment is received promptly in full, legal proceedings will not be taken
3a. payment plans are available for use of the client, such plans are designed to make it simpler for the client to pay the agreed amount(s), if a payment is missed, it is the clients responsibility to immediately inform Better Life therapies of any missed payment(s), failure to do so can be interpreted as a contract breach and legal action for the recovery of owed money(s) may be taken.
It is the clients responsibility to pay any and all owed money(s) after the conclusion of any extensions or no contact periods granted by Better Lift Therapies.
The client MUST inform Better Life Therapy immediately of any payment problems are encountered by the client.
Upon informing Better Life Therapies of any missed payment(s), or payment problem, arrangement can be made for a rearrangement of the payment date(s), but such rearrangements are at the complete discretion of Better Life Therapies and may not be possible in all circumstances.
An extension period of 5 (five) days may be requested by the client in order to allow for payment, this 5 (five) day extension may only be used once by any client, alternatively a no contact period of 30 (thirty) days may be requested for any of the reasons stated in section 3b., this 30 (thirty) day no contact period may only be used once by a client, and ONLY for reasons outlined bellow, such as bereavement, family/personal emergency or financial emergency, these two, 5 (five) day extension and 30 (thirty) day no contact period may NOT be used in conjunction with each other..
Any extensions or no contact periods are used at the sole discretion of Better Life Therapies and may be cancelled or refused at any time.
Upon cancellation or refusal, full payment of any and all payments owed by the client will be immediately due.
3b. circumstances that will be considered and taken into account for missed payments and the issuing of ether a 5 (five) day extension, or 30 (thirty) day no contact period include but are not limited to...
Bereavement
Family/personal emergency
Financial emergency
Or other such events that cannot be predicted by any individual.
Better Life Therapies may, on occasion seek proof of the emergencies a client states, such as financial emergencies,and it is the clients responsibility to provide such proof if required.
No proof will be required in the case of bereavement, however, notification will still be required, BEFORE the 30 (thirty) day no contact period can begin.
If contact is not made, it will be assumed that the client is in breach of contract.
Upon completion of ether the 5 (five) day extension or 30 (thirty) day no contact period, payment must be made of any and all outstanding money(s) owed by the client in full.
3c. Better Life Therapies always seeks to be understanding and flexible with its clients, as such, if contact is made by the client, Better Life Therapies will try to be as flexible and understanding as possible, considering all circumstances.
In the case of such emergencies as stated above, a standard no contact period of 30 (thirty) days, may be implemented by Better Life Therapies, after which full payment of any outstanding amounts will be due in full.
This 30 (thirty) day no contact period, and its implication are at the sole discretion of Better Life Therapy and the 5 (five) day extension and its implication, are at the total discretion of Better Life Therapy.
Section 4
Payment extension and no contact period
In certain circumstances a payment extension of 5 (five) days or a no contact period of 30 (thirty) days may be instituted, these are stand alone and may NOT be used in conjunction with one another, and are instituted at the sole discretion of Better Life Therapies.
Better Life Therapies reserves the right to remove any and all of these at any time, if the removal of either of these is instituted, Better Life Therapies will give the client 72 (seventy two) hours notice before complete removal of ether of these items.
After removal, the client will be responsible for prompt and complete payment of any and all outstanding amounts.
4a. situations in which these items may be removed, include but are not limited to…
False or incorrect information provided to Better Life Therapy in ANY WAY
ANY of the conditions listed in section 1 (one)
ANY behavioural misconduct as listed, but not limited to, items listed in section 1c.
Police enquiries about the client in any context
4b The client has the right to appeal the removal of these items through contacting Better Life Therapies by phone or email, this MUST be done within 5 (five) days of being notified of the removal being implemented.
Better Life Therapies holds its self to the highest standards and as such will consider ALL appeals in a fair and unbiased way, should it be found that the appeal is upheld in favour of the client, any of these items which where removed will be put back in place and a written apology issued by Better Life Therapies along with an unconditional payment break of 60 (sixty) days, after which period the client will be responsible for full payment of any and all outstanding amount(s).
Should the appeal be denied, the client shall be liable for full payment of any and all outstanding money(s) within a 10 (ten) day period, after which, if no contact has been able to be established, legal action may be taken to recover any money(s) owed.
Section 5
Acceptable payment methods
Payment is acceptable in the form of
Cash
Bank transfer
PayPal
Payment types other than the ones listed shall NOT be acceptable
Section 6
The responsibilities of Better Life Therapies
Better Life Therapies shall always provide the best treatment possible within the knowledge and training received.
Better Life Therapies is NOT a substitute for conventional medical care provided by a clients doctor, nor do we claim to have better knowledge, Better Life Therapies specialises in alternative treatments.
It shall be the responsibility of Better Life Therapies to ensure the client understands that the treatment they receive from Better Life Therapies is NOT a replacement for conventional medical procedures or treatments and that they undergo treatments from Better Life Therapies of their own free will.
It shall be the responsibility of Better Life Therapies to instruct the client to seek medical advice from their doctor before undergoing any and all treatments, it shall also be the responsibility of Better Life Therapies to instruct the client to seek medical advice from their doctor should a situation arise during a treatment session that is or could be a concern, or that Better Life Therapies is unable or ill equipped to deal with.
It is NOT the responsibility of Better Life Therapies to check if a client has sought medical advice before their treatment, or after being told of a potential concern, neither will Better Life Therapies be held responsible for any consequences resulting from such.
After the client has been instructed to seek medical advice both before seeking treatment and in the case of seeking medical advice about a potential concern, Better Life Therapies assumes the client will have done so, and accepts NO responsibility for the client providing false information when asked about this, neither will Better Life Therapies be held responsible for any consequences of such
It is NOT the responsibility of Better Life Therapies to follow up with a client regarding medical treatment, it shall be assumed that the client will have sought medical advice after being advised to do so.
It shall also be assumed that any relevant information will have been provided by the client to Better Life Therapies.
Section 7
By entering into a contract with Better Life Therapies or anyone associated therewith, the client does agree with ALL terms and conditions outlined herein, and does absolve Better Life Therapies and any of the persons involved therewith of ANY AND ALL responsibility for, but not limited to, ALL of the things contained herein.
